D. Donne Bryant (DDB) Stock Photography
Terms of Acceptance of Original Transparencies
Please read this form carefully. Sign and return with your initial submission of photographs
D. Donne Bryant Stock Photography (hereinafter called DDB Stock or Agency) accepts transparencies from
the contributing photographer subject to the following terms which are fair and accepted by the
stock photography industry.
- Photographer understands that DDB Stock acts only as an agent marketing and promoting
images photographer consigns to the agency; photographer is not an employee of DDB Stock.
Photographer recognizes that when a lease takes place, the resulting fee will be split 50/50
between photographer and agency. Photographer recognizes that payments are sent out on a
quarterly basis.
- Photographer recognizes that it is prohibitively expensive for DDB Stock to fully and
properly insure photographer's images, and hence DDB Stock does not maintain insurance
for any loss, damage or deterioration of photographer's transparencies from any cause
including, but not limited to fire, theft, vandalism, water, and accident. Photographers
may maintain their own insurance coverage of images sent to DDB Stock.
- Photographer agrees to hold DDB Stock blameless for any such loss, damage or
deterioration of photos, slides, transparencies, negatives, or other images, whether
original or copy. Photographer understands that agency shall split compensation received
from a clients for loss or damage, if received, on a 50/50 basis.
- Photographer understands that images should be sent to DDB Stock by registered
mail or express courier with proof of delivery.
- Photographer recognizes that DDB Stock does not represent their work on an exclusive
basis. Photographer is free to market copies, in-camera dupes, and digital copies of images
consigned to DDB Stock in any manner they choose with one exception. Photographers may not
sell exclusive rights to copies, in-camera dupes, or digital copies of images consigned to DDB
Stock without written permission from the agency, which may be granted only at DDB Stock's discretion.
- Photographer agrees that DDB Stock may hold original slides and transparencies for a
minimum initial period of 5 years from date of receipt. Photographer may request return of
original slides and transparencies at any time after the initial holding period. DDB Stock
will return original slides transparencies on hand within 5 months of receipt of request and
within 12 months for images out on consignment to clients.
- Photographer agrees that DDB Stock may market their digital images, whether scanned in-house
or delivered digitally, for a period of 10 years from date of receipt. This defrays the high cost DDB
Stock incurs placing, maintaining, and marketing digital images on the Internet.
- The above terms will apply to all photographs in past, present and future submissions
accepted by DDB Stock.
- The terms contained in this agreement cannot be amended or modified unless agreed to
in writing by DDB Stock and the photographer.
I, the undersigned, agree that all transparencies sent to DDB Stock are accepted by DDB Stock
under the above terms.
